Florida Hospitals Sue for Payments for Care for Undocumented Residents

Florida hospitals are challenging the state’s implementation of a Medicaid regulation that calls for the state to pay hospitals only for the care they provide to stabilize undocumented, uninsured patients but not for any additional care those patients require.

The state maintains that it was always supposed to pay according to this standard even as it implemented a new Medicaid regulation reinforcing that standard.  It also is seeking to recover, retroactive to 2005, all Medicaid payments to hospitals beyond those for services that stabilized undocumented, uninsured emergency patients.

Such a policy has major implications for the state’s urban safety-net hospitals, many of which – especially in the Miami area – care for significant numbers of undocumented, uninsured patients.
